Customers using Automatic Telephone Dialing Systems (ATDS) and/or artificial or prerecorded voices or messages - including AI-generated voice - must abide by the FCC TCPA and other applicable state and federal laws, as well as industry and carrier standards. Failure to comply with these requirements could result in non-compliance litigious action, penalty fees and/or suspension of services. To avoid potential consequences of non-compliance, review these key points:
- Comply with all STIR/SHAKEN authentication requirements
- Regularly check subscriber lists against reassigned number databases and remove the numbers accordingly
- Cease calling any aforementioned reassigned phone numbers (wired and wireless)
- Maintain compliance with consent standards. (Note: If a recipient ports their landline phone number to a wireless number, consent to calls remains intact.)
- Download and scrub against the National Do Not Call Registry (DNC Registry) at least every 31 days barring applicable exemption.
- Provide multiple identity and purpose disclosures, a phone number for Do Not Call requests, and an automated interactive voice or key-press operated opt-out mechanism
Convey takes compliance matters seriously and encourages customers to verify that all programs follow the above-mentioned guidelines. Convey and upstream providers reserve the right to suspend non-compliant campaigns/programs or campaigns/programs that appear to be fraudulently registered.
