Customers sending business emails in the U.S market are subject to the Federal CAN-SPAM Act and any other applicable state or federal law and service provider guidelines. Failure to comply with these guidelines could result in non-compliance penalty fees and/or suspension of services. To avoid potential consequences of non- compliance, please review these key points:
- Header information must accurately reflect and identify the sending person or business
- Subject lines must accurately reflect the message content
- Marketing/promotional emails must clearly and conspicuously disclose they are an an advertisement
- Include a valid physical postal address
- Provide a clear and conspicuous explanation for how to opt out of future emails. Opt-outs must be honored within 10 business days.
- Avoid sending bulk or multiple emails at one time
- Best practice is to send all messages from the same IP address. If using multiple IP addresses, use a different IP address for each message type.
Convey takes compliance matters seriously and encourages customers to verify that all programs follow the above-mentioned guidelines. Convey and upstream providers reserve the right to suspend non-compliant campaigns/programs or campaigns/programs that appear to be fraudulently registered.
Additional Requirements for Sexually Explicit Content
E-mails containing sexually explicit content must include the warning “SEXUALLY-EXPLICIT:” at the beginning of the subject line. Additionally, when recipients open the message, the only viewable content may be:
- The words "SEXUALLY-EXPLICIT:"
- Standard disclosures; such as whether the email is an advertisement/promotional in nature, the sender's postal address, and instructions to opt out.
No graphics may be displayed. Recipients must not be able to view sexually explicit content without performing an affirmative action (eg. click a link or scroll down).
